This Terms of Service Agreement ("Agreement") is a legal contract between Mobox ("Mobox," "We," "Us," or "Our") and you ("User," "You," or "Your") regarding the use of our Mobox hyperlocal delivery service application (“App”) for managing and delivering goods in your local area. By accessing or using the Mobox App, you acknowledge and accept these Terms.
Mobox grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the App solely for lawful purposes as specified in this Agreement. This license is for your own use and does not transfer any ownership or intellectual property rights.
2.1 Eligibility: Users must be at least 18 years of age to use the App.
2.2 Security and Compliance: You agree to use the App in compliance with all security requirements and to follow our data protection measures. You will not:
- Attempt to bypass or breach any security device, restriction, or safeguard.
- Modify, reverse-engineer, or misuse the App.
- Engage in activities that compromise the security of the App, our infrastructure, or other users' data.
2.3 Technology Protection: The App may include digital rights management (DRM) software and other technologies to prevent unauthorized use. By using the App, you consent to DRM installation on your device, which may require a network connection to activate. You agree to refrain from disabling or circumventing any DRM or security features.

By using the App, you consent to the data collection, use, and storage practices detailed in the Privacy Policy, including handling sensitive information necessary for the App’s hyperlocal delivery services.
4.1 Security Measures: You are responsible for maintaining the confidentiality of your login credentials and for any activities conducted through your account. You agree to notify us immediately at compliance@mobox.ai if you suspect unauthorized access or use of your account.
4.2 Network and Device Requirements: Using the App requires an internet connection, and network performance may affect the App's functionality. Mobox is not responsible for any issues arising from third-party network services or connectivity.
5.1 Subscription and Usage Fees: Access to certain features of the App may be subject to fees. You agree to pay all applicable charges as specified in your account or purchase plan.
5.2 Billing and Renewals: Subscription services renew automatically unless canceled by the user prior to the renewal date. Charges are non-refundable except as required by law.
All rights, titles, and interest in the App, including any modifications, are owned by Mobox. This Agreement does not transfer any ownership rights. Unauthorized use or reproduction of the App is prohibited.
7.1 Termination by User: You may terminate this Agreement by ceasing use and deleting the App.
7.2 Termination by Mobox: We may terminate or suspend your access if we believe you have violated this Agreement, applicable law, or engaged in activities that endanger our system security.
8.1 Security Disclaimer: While we strive to ensure the App’s security, no internet-based service can be entirely secure. You acknowledge that there are inherent risks associated with internet-based services that could impact the security of your data.
8.2 Limitation of Liability: Mobox shall not be liable for any indirect, incidental, or consequential damages, including data loss or unauthorized account access. Mobox’s total liability will not exceed $1,000.00 or the amount paid by you in the preceding 12 months, which ever is greater.
9.1 No Warranty: The App is provided on an “as is” basis without any express or implied warranties, including but not limited to, merchantability or fitness for a particular purpose.
You agree to indemnify Mobox against any claims or damages arising from your use of the App, violation of these Terms, or infringement of third-party rights.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes will be resolved exclusively in Florida state or federal courts.
We reserve the right to modify these Terms. Any changes will be effective upon posting on our website or through the App.
